Terms of Service

By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.

You must be at least 21 years old (or the minimum legal age for sports wagering in your jurisdiction, whichever is higher) and legally permitted to view sports-betting information where you live. By using the Service, you affirm that you meet these requirements. Sports betting is regulated differently in every jurisdiction; you are solely responsible for knowing and following the laws that apply to you. We may restrict or block access in regions where the Service is not permitted.

SmartSide is an information, analytics, and companion tool. We aggregate publicly available odds, provide research and modeling tools, and let you track your own bets. SmartSide is not a sportsbook or gambling operator: we do not accept, place, broker, or settle wagers, we do not take deposits, and we do not pay out winnings. Any wager you place happens on a third-party, licensed sportsbook subject to that operator’s own terms.

You are responsible for the accuracy of your registration information and for keeping your credentials secure. You are responsible for all activity under your account. Notify us promptly at support@smartside.bet of any unauthorized use. One person may not maintain multiple accounts to abuse trials, referrals, or promotions.

• SmartSide offers a free tier and paid subscriptions (e.g. Pro and Elite). Paid features are billed through Stripe on a recurring basis (monthly or annual) at the price shown at checkout.
• Auto-renewal: your subscription renews automatically at the end of each billing period until you cancel. You authorize us and Stripe to charge your payment method for each renewal.
• Cancellation: you can cancel anytime from your account or billing portal. Cancellation stops future renewals; your paid access continues until the end of the current period.
• Refunds: except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused features, or losing bets.
• Price changes: we may change prices; we will give notice before a change affects your renewal.
• Capper marketplace: purchases of third-party capper picks are processed via Stripe and are subject to these Terms and any additional terms shown at purchase.

You agree not to:

• Scrape, resell, or redistribute our odds, data, or content except as expressly allowed.
• Reverse engineer, disrupt, or attempt to gain unauthorized access to the Service.
• Use the Service for any unlawful purpose or where sports-betting information is prohibited.
• Post false, misleading, infringing, or abusive content, including fabricated track records.
• Use bots or automated means to abuse trials, referrals, or promotions.

We may suspend or terminate accounts that violate these rules.

Some content is posted by third-party “cappers” or other users. Their picks, analysis, and records are their own and do not represent SmartSide’s advice or endorsement. You are responsible for evaluating any pick before acting on it. Cappers are responsible for the accuracy of what they post and grant us a license to display their content on the Service.

SmartSide participates in sportsbook affiliate and referral programs. When you click an outbound link to a sportsbook and sign up or deposit, we may earn a commission at no additional cost to you. Affiliate relationships never change the odds we show or where a “best line” is highlighted — rankings are driven by the data, not by who pays us. Outbound links take you to independent, licensed operators governed by their own terms.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Odds, lines, projections, expected-value figures, and AI-generated breakdowns are informational only and may be delayed, inaccurate, or incomplete. No bet is ever a lock. Past performance and modeled edges do not guarantee future results. We do not guarantee any winnings, and nothing on the Service is financial, legal, or professional advice. You alone are responsible for your betting decisions and any money you risk.

To the fullest extent permitted by law, SmartSide and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost bets, or gambling losses, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Please read this section carefully — it affects your legal rights. You and SmartSide agree that any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and SmartSide waive any right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing legal@smartside.bet within 30 days of first accepting these Terms. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

You may stop using the Service and delete your account at any time from Settings → Delete account. We may suspend or terminate your access if you violate these Terms or if required by law. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and arbitration) will survive.

We may update these Terms from time to time. We will update the effective date and, for material changes, provide notice in-app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
